Your Built Environment Firm’s Website Is Probably Collecting Data You’re Not Allowed to Use. Here’s Why.

If you run Google Analytics on your firm’s website, you’re in good company. In The Digital Blueprint: Built Environment 2026, our new sector-wide research study, we found that 63.8% of UK architecture, engineering, construction, planning and quantity surveying firms do exactly the same.

Here’s the part most of them haven’t looked at closely. Over 75% of those firms have no consent infrastructure in place to legally use the data they’re collecting.

That’s a live compliance gap, not a technicality, and it’s sitting on almost every built environment website in the UK. Most firms have no idea it’s there.

What “consent infrastructure” means

Running Google Analytics without the right consent setup means tracking visitors without a proper legal basis to do so. In practice, consent infrastructure covers a few things:

  • A compliant cookie consent banner, one that actually blocks tracking scripts until a visitor opts in, rather than a banner that simply disappears when it’s clicked.
  • A documented lawful basis for the data you collect and how you use it.
  • Data processing agreements with the tools you rely on (Analytics, CRM, ad platforms) that confirm how they handle that data on your behalf.

Most firms have the first half of this picture, the tracking. Very few have the second half: the paperwork and technical setup that makes the tracking legitimate.

Why this matters more than you think

It’s tempting to file this under something the legal team will sort out eventually. Two things make it more pressing than that:

  • It’s a live risk, not a hypothetical one. Every day a site tracks visitors without proper consent is a day of live exposure, not a future problem to fix before an audit.
  • It undermines everything built on top of it. If your data collection isn’t compliant, every decision you base on that data, which pages perform, where leads come from, what content to invest in, is standing on shaky ground.

How we found this

To produce The Digital Blueprint: Built Environment 2026, we assessed 533 active UK built environment firms using headless browser technology. That let us measure what real users and search engines actually see, not just the underlying code. It’s the first sector-wide digital benchmark of its kind for the industry.

How the sector compares

We scored every firm across five digital maturity pillars: Tech Stack, Technical SEO, Website Performance, Local Visibility and Brand Authority. Discipline mattered less than you might expect:

  • Quantity surveying firms scored lowest overall, at a composite mean of 52.9, nearly five points below the sector average.
  • Architecture firms scored highest, at 59.2.
  • Main contractors sat just below the sector mean, at 56.2.
  • Planning consultancies scored 54.6, with one of the widest performance spreads of any discipline, meaning some planning firms are excelling while others lag well behind.

The pattern across the board: digital leadership isn’t decided by what kind of firm you are. The top performers in our dataset span every discipline we assessed

3 Things you can change on your site this month

You don’t need a full legal overhaul to start closing the gap:

  • Audit your current cookie and consent banner. Does it block tracking scripts before consent, or does it just show up and get ignored?
  • Check what you’re collecting against what you’re actually using. If you’re not using certain data, it’s worth asking whether you need to collect it at all.
  • Get a data processing agreement in place with your analytics and CRM providers, if you haven’t already.
